+8.5 Prior Commercial Licensees. Any company, organisation, or other legal entity that has at any time held, or been named on, a valid paid license, subscription, Order Form, or other paid entitlement for OpenFaaS Standard, OpenFaaS for Enterprises, or OpenFaaS Edge (collectively, "Commercial Editions") is permanently ineligible to use the OpenFaaS Community Edition under this Agreement, whether for evaluation, internal use, migration, contingency, or any other purpose. This restriction applies regardless of whether the prior Commercial Edition has expired, been terminated, been suspended, or not been renewed. For the avoidance of doubt, the 60-day evaluation period in Section 8.1 does not apply to, and may not be invoked by, any such prior commercial licensee. The OpenFaaS Community Edition may not be used as a bridge, downgrade, fallback, replacement, or continuation of use following the expiry, termination, suspension, or non-renewal of any Commercial Edition. Any use of the OpenFaaS Community Edition in breach of this Section 8.5 shall constitute unauthorised use of the software and a material breach of this Agreement, entitling OpenFaaS Ltd to exercise any rights or remedies available under this Agreement or applicable law.
